    TAKE NOTICE that the Council of the Corporation of the Town of Aylmer on the 18th day of June 2025 passed By-law Nos. 43-25 and 37-25, adopting Amendment No. 25 to the Town of Aylmer Official Plan, pursuant to Section 17 of the Planning Act, R.S.O. 1990, as amended and passing a Zoning By-law Amendment to the Town of Aylmer Comprehensive Zoning By-law 57-99, pursuant to Section 34 of the Planning Act, R.S.O. 1990, as amended.

    The subject lands are legally described as Part of Lots 15, 16 and 17 W/S Wellington St Plan 74 and known municipally as 22 Wellington Street, Aylmer, as shown on the key map on the back of this notice.

    THE PURPOSE AND EFFECT of the Application for Official Plan Amendment is to redesignate the subject lands from Medium Density Residential to High Density Residential to permit a three (3) storey residential apartment building consisting of twenty-two (22) dwelling units.

    THE PURPOSE AND EFFECT of the Application for Zoning By-law Amendment is to rezone the subject lands from Residential Type 2 Special Provision Zone (R2) and Support Commercial (C2) to Residential Multiple Second Density Special Provision Zone (RM2-13) to permit an apartment building with the following zone deficiencies:

    The Written Submissions are summarized in the Statutory Public Meeting portion of the Council Meeting minutes of June 4, 2025 and in the Council Meeting minutes of June 18, 2025; and were considered as part of the effect on the decision-making process.

    SUBMISSION TO APPROVAL AUTHORITY

    The proposed local Official Plan Amendment will be submitted to the County of Elgin (the approval authority) for approval. Any person or public body will be entitled to receive notice of the proposed decision of the approval authority in respect of the proposed Official Plan Amendment if a request to be notified of the proposed decision is made to the approval authority by email: planning@elgin.ca.

    AND TAKE FURTHER NOTICE that a specified person or public body may appeal to the Ontario Land Tribunal with respect to the Zoning By-law Amendment by filing with the Clerk of the Corporation of the Town of Aylmer, no later than July 9th, 2025, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, accompanied by the fee required by the Tribunal in the amount of $1100.00 which must be in the form of a certified cheque, money order or credit card made payable to the Ministry of Finance and in Canadian funds. An Appellant may request a reduction of the filing fee to $400 if the Appellant is a private citizen or eligible community group. The request for a reduction in the fee must be made at the time of filing the appeal. If you wish to appeal, you may do so online or a copy of an appeal form is available from the Ontario Land Tribunal https://olt.gov.on.ca/file-an-appeal/.

    The specified person or public body may appeal a zoning by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. No person or public body shall be added as a party to the hearing of the appeal unless, before the By- law was passed, the person or body made oral submissions at a public meeting or written submissions to the Council, or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.     PLEASE TAKE NOTICE that the Town of Aylmer Committee of Adjustment will hold a Hybrid (in-person and virtual) Public Hearing on Wednesday, July 9th, 2025, at approximately 7:00 p.m. to consider Application for Minor Variance A02-25 with a public livestream available at www.youtube.com/TownofAylmer. You are invited to participate in the Hybrid Public Hearing to provide verbal or written comments regarding this matter.

    Purpose and Effect of Application A02-25
    The subject lands are located within the Low Density Residential land use designation of the Town of Aylmer Official Plan. The subject lands are also zoned Residential Type 1 (R1) in the Town of Aylmer Comprehensive Zoning By-law No. 57-99. The subject lands contain a single detached dwelling (outlined in yellow on the back of this notice). Section 22(a)(i)(1.) of the Zoning By-law states no private open swimming pools or related structures shall be permitted anywhere within the zoned area except an interior side yard or rear yard on a lot containing a permitted dwelling unit; the owner is proposing to construct an above ground pool in the front yard directly west of the dwelling unit. The above ground pool will be fenced, and the owner is also requesting relief from Section 1.5 of the Town’s Division and Privacy Fence By-law to permit a fence height of 1.8 m (6.0 ft.) in the front yard whereas the by-law only permits a fence height of 0.9 m (3.0 ft.).

    Location and Description of Subject Land
    The subject lands are legally described as Part of Lot 1 Plan 11M52 Block 74 Plan 11M90 and Part 2 11R7190, Town of Aylmer (geographic Town of Aylmer), and is known municipally as 9 Rebecca Drive, Aylmer. The location and proposed development are shown on the Key Map and sketch attached to this notice.

    Any person or public body may attend the Hybrid Public Hearing and/ or make written or verbal representation either in support of, or in opposition to the Minor Variance. If you wish to attend the Public Hearing virtually, please contact the Manager of Planning and Development by email or by phone by no later than noon on July 9th, 2025, to receive an invitation to the hearing. Verbal representation for the Hybrid Public Hearing may be provided in-person or electronically. Written comments can be submitted by email to the Manager of Planning and Development or in-person to the Town Hall Office by no later than noon July 9th, 2025. Please note that comments and opinions submitted on these matters, including the originator’s name and address, become part of the public record, and may be viewed by the public and may be published in a Planning Report, Council/Committee Agenda or Council/Committee Minutes.

    If you rent your property to seven (7) or more tenants, please post a copy of this notice in a location on your property, which is visible to all the residents.

    If a specified person or public body does not make oral submissions at the Hybrid Public Hearing or make written submissions to the Secretary-Treasurer of the Town of Aylmer Committee of Adjustment before the minor variance is granted, the specified person or public body is not entitled to appeal the decision of the Town of Aylmer to the Ontario Land Tribunal.

    If a specified person or public body does not make oral submissions at the public hearing or make written submissions to the Secretary-Treasurer of the Town of Aylmer Committee of Adjustment before the minor variance is granted, the specified person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to do so.
