Notice of Passing - ZBA01-26 - 10 Sydenham St West and 32 & 50 Centre St, Aylmer
TAKE NOTICE that the Council of the Corporation of the Town of Aylmer on the 17th day of June 2026 passed By-law No. 47-26, passing a Zoning By-law Amendment to the Town of Aylmer Comprehensive Zoning By-law 57-99, pursuant to Section 34 of the Planning Act, R.S.O. 1990, as amended.
The subject lands are legally described as Part of Lot 5 N/S Sydenham W/S Centre, Lots 6 and 7 N/S Sydenham Street W/S Aylmer Street and Port Bruce Gravel Road Plan 164 and known municipally as 103 Sydenham Street West and 32 & 50 Centre Street, Aylmer, as shown on the key map on the back of this notice.
The Written Submissions are summarized in the Statutory Public Meeting portion of the Council Meeting minutes of June 17, 2026 and in the Council Meeting minutes of June 17, 2026; and were considered as part of the effect on the decision-making process.
THE PURPOSE AND EFFECT of the Application for Zoning By-law Amendment is to rezone the lands identified as the proposed severed parcel, known municipally as 103 Sydenham Street West from Residential Office (RO) to Residential Office Special Provision 10 (RO-10) to permit the severance of the existing single detached dwelling with the following zoning deficiencies:

The lands proposed to be rezoned RO-10 will contain the existing single detached dwelling with attached garage and will continue to have access to Sydenham Street West.
THE PURPOSE AND EFFECT of the Application for Zoning By-law Amendment is to also rezone the lands identified as the proposed retained parcel, known municipally as 32 & 50 Centre Street and a portion of 103 Sydenham Street West from Residential Office (RO) to Residential Multiple Second Density Special Provision 15 (RM2-15) to permit a three (3) story residential apartment building, containing twenty-three (23) units. The proposed RM2-15 zone will have the following zoning deficiencies:

The proposed apartment building will have one (1) and two (2) bedroom units and will be split between affordable rent of 70-79% average market rent and average market rent. Access is proposed from Sydenham Street West.
TAKE NOTICE that a specified person or public body may appeal to the Ontario Land Tribunal with respect to the Zoning By-law Amendment by filing with the Clerk of the Corporation of the Town of Aylmer, no later than July 8th, 2026, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, accompanied by the fee required by the Tribunal in the amount of $1100.00 which must be in the form of a certified cheque, money order or credit card made payable to the Ministry of Finance and in Canadian funds. An Appellant may request a reduction of the filing fee to $400, if the Appellant is a private citizen or eligible community group. The request for a reduction in the fee must be made at the time of filing the appeal. If you wish to appeal, you may do so online, or a copy of an appeal form is available from the Ontario Land Tribunal https://olt.gov.on.ca/file-an-appeal/.
The specified person or public body may appeal a zoning by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. No person or public body shall be added as a party to the hearing of the appeal unless, before the By- law was passed, the person or body made oral submissions at a public meeting or written submissions to the Council, or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
